Draft legislation implementing the EUDR published
The RCL website has published a draft legislation on protecting the market and the competitive economy from products and goods that cause deforestation and forest degradation (UC 101). This legislation aligns national regulations with the requirements of the EUDR.
In accordance with the draft and in the spirit of the EUDR, every commercial offer and the documentation accompanying the product must include the reference number of the due diligence statement or the identifier of the simplified declaration.
The Environmental Protection Inspectorate will serve as the key competent authority for our industry and will be responsible for conducting inspections. In accordance with the adopted guidelines, the draft law provides for the designation of the following competent authorities within the meaning of the EUDR:
- the Veterinary Inspection authorities – with regard to cattle and the relevant products listed in Annex I to the EUDR Regulation that contain the relevant commodity referred to above or have been produced using it;
- the Agricultural and Food Quality Inspection Authorities – with respect to cocoa, coffee, oil palm, and soybeans, as well as related products listed in Annex I to the EUDR Regulation that contain the aforementioned commodities or have been produced using them;
- Environmental Protection Inspection authorities – with respect to timber and rubber, as well as the relevant products listed in Annex I to the EUDR, which contain the above-mentioned relevant commodities or have been produced using them.
The draft also outlines penalties and corrective measures for non-compliance, including the possibility of recalling products from the market or confiscating them.
According to the legislator, the Act will enter into force 14 days after its publication. This applies to most key institutional frameworks, including the designation of the Environmental Protection Inspectorate as the competent authority for the timber industry. Additionally, on December 30, 2026, provisions regarding changes to reporting or specific information obligations will take effect (Article 34(1) of the draft).
